Call To Order

The Public Policy Committee convened on Thursday, November 3, 2016 in Colony Ballroom E at the Sonesta Bee Cave — Austin, 12525 Bee Cave Parkway, Bee Cave, TX 78738. Public Policy Committee Chair Lora Taylor called those present to order at 1:30 p.m.

  1. Introductions
    Chair Taylor asked the Committee members, staff, and guests to introduce themselves and where they are from and to share what they are thankful for.

  2. Public Comments
    Public comment was deferred until later in the agenda.

  3. Consideration of Minutes
    The Committee reviewed the minutes from the August 4, 2016, Public Policy Committee meeting.

  4. Chair’s Remarks
    Chair Taylor reviewed absences and reported on the recent events that she attended, including an accessible parking hearing and the Lex Frieden Employment Awards hosted by the Governor’s Committee on People with Disabilities. Taylor thanked Hunter Adkins for providing testimony for the accessible parking hearing.

  5. Member Updates
    April Young notified the Committee that Nancy Walker, Health and Human Services Commission (HHSC) agency representative to the Council, retired and will no longer attend meetings. In addition, Young (HHSC alternate for Walker) will no longer represent the agency during council meetings due to the health and human services transformation and expects a new HHSC representative to be named by the February 2017 meeting.

  6. Disproportionalities and Disparities Discussion
    The Committee discussed TCDD strategies to address disproportionality and disparities. Agency representatives shared tools and strategies their organizations use to increase responsiveness to the beliefs, interpersonal styles, attitudes, language, and behaviors of individuals who receive their services.

  7. TCDD Position Statement Review
    The Committee reviewed and recommended updates for the following Position Statements: Transportation, Criminal Justice, Right to Privacy, Service Coordination, and Education.

    Chair Taylor presented the Transportation Position Statement and explained the purpose of the recommended revisions. The statement was edited for plain language and adds a data element about inadequate access to transportation.

    MOTION: To recommend Council approval of the Transportation Position Statement as presented.

    Chair Taylor presented the Criminal Justice Position Statement and explained the purpose of the recommended revisions. The statement was edited for plain language, adds a reference to state-supported living center admissions, recommends comprehensive law enforcement training, and clarifies competency proceedings and assessments.

    MOTION: To recommend Council approval of the Criminal Justice Position Statement as presented with one edit to delete “and” from the last sentence of the first paragraph to read “People with intellectual disabilities are 4 to 10 times more likely to be victims of crime than those without disabilities.”

    Chair Taylor presented the Right to Privacy Position Statement and explained the purpose of the recommended revisions. The statement was edited for plain language and adds Confidentiality of Information” to the title; defines “Privacy” in the first paragraph with reference to the fourth amendment; and adds a new sub bullet on identifying information.”.

    MOTION: To recommend Council approval of the Right to Privacy Position Statement as presented.

    Chair Taylor presented the Service Coordination Position Statement and explained the purpose of the recommended revisions. The statement was edited for plain language in addition to notable edits which emphasize person centered planning and meaningful, full community participation; clarify conflict of interest in service delivery and further define the responsibilities of the service coordinator.

    MOTION: To recommend Council approval of the Service Coordination Position Statement as presented with three additional revisions:

    • Replace “culturally competent” with “culturally appropriate” in the last sentence of the sixth paragraph.
    • Delete “to participate” in the last sentence of the second paragraph.
    • Delete “purpose of public benefits” in the first bullet in the eighth paragraph.

    Chair Taylor presented the Education Position Statement and explained the purpose of the recommended revisions. The statement was edited for plain language and current terminology in addition to notable edits relating to the identification of students with disabilities teacher and service provider qualifications; the support of school-wide positive behavioral interventions and supports and emphasis on full, meaningful inclusion of Texas students with disabilities.

    MOTION: To recommend Council approval of the Education Position Statement as presented.

  8. Public Policy Staff Activities
    The Committee received updates from staff regarding recent state policy issues and staff activities including the TCDD HHSC Legislative Appropriations Request (LAR) summary, percentage of students in special education, TCDD’s School Choice Issue Brief, and the Texans Care for Children’s Early Childhood Intervention (ECI) brief. Committee members referenced binder and handout folder materials compiled by staff for each update.

    Chair Taylor agreed to receive public comment at this point due to its relevance to the agenda item. Linda Litzinger, Public Policy Specialist for Texas Parent to Parent, offered public comment regarding ECI reporting. Litzinger commented that many ECI providers’ annual financial reports do not accurately reflect their dire financial state due to administrative requirements that do not allow providers to report negative balances.

    The Committee received updates from staff regarding State Supported Living Centers (SSLCs) including the Texas Public Policy Foundation’s SSLC Issue Brief, TCDD’s Criminal Justice Issue Brief regarding detained alleged offenders with IDD, and updates regarding the federal Supreme Court of the United States case, Endrew v. Douglas County School District, related to educational benefits and the Individuals with Disabilities Education Act (IDEA). Committee members referenced binder and handout folder materials compiled by staff for each update.

  9. Selection of TCDD Nominating Committee Member
    Chair Taylor asked for a nomination or a volunteer from the Public Policy Committee for a member of the Nominating Committee. Michael Peace nominated Hunter Adkins.

    MOTION: To select committee member Hunter Adkins to serve as TCDD Nominating Committee Member for the Public Policy Committee.

  10. Other Discussion Items
    The Committee received an update regarding the 85th Texas Legislature and upcoming legislative office visits in February.
